TERMS AND CONDITIONS OF CONTEST TITLED 'Happy New Year Contest' ON THE CHANNEL 'ZEE TV'
1. The contest titled 'Happy New Year Contest' ("Contest") is open for participation to Indian viewers upon completion of 18 (eighteen) years of age by the individual, by answering the questions that appear during the movie'Happy New Year' to be telecasted on the channel 'Zee TV'on 26th January, 2015 at 1 pm
2. The Contest is conducted by the Company - Zee Entertainment Enterprises Limited ("ZEEL") on its television channel 'Zee TV' and the winners of the Contest shall be gratified from Kalyan Jewellers.
3. Tax implication on the Prize shall be as follows:
Option 1 - The winners may take the Prize by paying tax of 30% (thirty percent) over and above the cost of the Prize; or
Option 2 - If the winner/s is/are not able to pay 30% (thirty percent) tax over and above ,then tax of 30% (thirty percent) shall be deducted from the amount equivalent and shall be given to the winners.
4. There shall be no other prize option except as given as per Option 1 & 2 above.
5. The Contest shall commence from 1 p.m. on 26th January, 2015 and shall end at 5 p.m. on 26th January, 2015.
6. The participants of the Contest shall be required to send their answers via SMS to 57575.The participants should mention the complete details of their name and city in the required format.
7. ZEEL shall verify all the entries received by them, amongst whichthe top 8 (eight) will be selected by means of random selection. The shortlisted participants shall be required to provide the following documents for their entry to be considered valid in the Contest namely:
(a) Pan Card; and
(b) Proof of identity cum permanent address proof - Aadhar card / Election card/Passport/permanent Driver's License.
8. The 8 (eight) winners shall be announced on 26th January, 2015 on 'ZEE TV' channel.
9.The winners shall be contacted by the team of ZEEL on the contact number furnished by the winners in their entries. In an event if any of the winner(s) does/do not receive/s a call from ZEEL by 2nd February, 2015, the winner(s) shall be expected to contact ZEEL on the email ID:response@zee.eeselgroup.com within 7 (seven) days from 2nd February, 2015. If ZEEL does not receive any response from the winner(s) within 15thFebruary, 2015, the winner/s shall not have any right to claim for the declared Prize or whatsoever.
10.ZEEL shall announce the winners of the Contest, pursuant to which the winners can collect the Prize as their gratification. The winners shall be required to personally approach ZEEL along with their proof of identity for verification purposes alongwithsuch other required details as communicated from time to time and collect the said Prize. The coordination of the transaction shall be done via ZEEL.
11.The winners shall not have any right to claim for any kind of alternative in respect of the declared Prize.
12.ZEEL does not and shall not subscribe for any claims / disputes / confirmation / responsibility in respect of this Contest including the terms and conditions and any breach thereof.
13.Each participant expressly agrees that by his/her participation in this Contest, ZEEL further can use the collected information, in any media or future promotional, publicity and marketing material, without any consent, reference, payment or other compensation to the participant, subject to applicable privacy and data protection laws.
14.ZEEL shall have the right to share the participant's personal information to any governmental or regulatory bodies if required by law, rule or statue and in response to a valid order of a court or authorized agency of the government or other legal process.
15.ZEEL takes appropriate technical and organizational measures to protect the personal information provided by the participant against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access. However, ZEEL cannot guarantee the security of any personal information or data which the participant discloses. In any event, participant agrees not to hold ZEEL responsible for any breach of security, except in case of negligence or willful default on the part of ZEEL under the relevant legislation.
16.Using of false names, email ID's or addresses shall be considered as suppressions of facts and if ZEEL has to suffer of any adverse consequence in this respect, the participant/s shall be penalised for the same in a manner as ZEEL may deem fit.
17.Participants found indulging in any malpractices such as cheating or creating dubious profiles or making dubious phone calls etc. shall be disqualified from the on-going Contest.
18.ZEEL at its sole discretion reserves the right to modify the terms and conditions relating to the Contest from time to time and/or suspend, shorten, modify, extend or cancel the same without prior notice, without stating any reason and no claim in this regard shall be entertained.
19.All disputes arising out of or related to this Contest shall be subject to the exclusive jurisdiction of courts at Mumbai alone and subject to the laws of India only.
20.The participants shall indemnify and hold ZEEL harmless, its group companies, affiliates and subsidiaries and their respective officers, directors and employees, against any loss that may occur to them due to non-adherence of these terms and conditions of the Contest.
21.Unless otherwise expressly stated, copyright, database right or similar rights in all material in relation to the Contest (including graphical images, text, video clips, demographics, sounds, demos, patches and other files) is owned, controlled or licensed by ZEEL or its affiliates and is protected or covered by copyright, trade mark, intellectual property law and other proprietary rights. Unless with prior permission, no part of this Website or Contest may be reproduced or transmitted to or stored in any other website, nor any of its pages or part thereof be disseminated in any electronic or non - electronic form, nor included in any public or private electronic retrieval system or service.
22.The decision of ZEEL on all matters, queries or disputes, concerning the Contest and its terms and conditions shall be final and no correspondence shall be entertained in this regard.
23.By participating in the Contest, each participant acknowledges and agrees to the terms and conditions herein and all related terms and conditions governing the Contest.
24.The duration and other rules/regulations of the Contest shall be at the discretion of ZEEL only.
